Introduction

The general contracting conditions described below (hereinafter "General Conditions"), exclusively rule the contractual relations between every user of the website www.thermion.eu and the seller, which is the company Triode Electronic Engineering S.L., of Spanish nationality, with CIF B02564813 and registered office at Cristóbal Pérez Pastor 3 6ºA, CP. 02004, Albacete, and registered in the Mercantile Registry of Albacete: volume 951, folio 160, page AB.24561 on January 26, 2015. The company's contact email address is thermion@thermion.eu, according to the Spanish Law 34/2002 of July 11, services to the information society and electronic commerce.

The product contracting procedure is carried out completely electronically through the website www.thermion.eu, having the same validity as a signature in person.

These general conditions of sale that are detailed below are the only ones applicable and replace any other condition or previous agreement, unless the parties expressly agree in writing to another type of agreement and this cancels or modifies these general contracting conditions.

The language used in the entire contracting procedure will be Spanish and it will be the language that rules the relations between the parties. The display of information in any other language will be considered conditional on the first, in case of discrepancy the Spanish version will prevail over any another translation or adaptation.

Triode Electronic Engineering S.L. may occasionally modify the stipulations contained in these general conditions, so it is advisable that they are read at each visit to the page www.thermion.eu. These modifications will take effect from their publication and will not have retroactive effects and will not be applicable to purchases made before them. The previous versions can always be consulted through the links that are contained in the platform and they will be printable and / or downloadable through the button established for that purpose.

Each purchase on the website is ruled by the general conditions applicable on the date of the order. We consider that once you have placed an order, you will have accepted without reservation our general conditions of sale after having read them.

By accessing the website, you agree to respect the general conditions as well as the conditions of use that appear therein.

Place an order

We put at your disposal the following methods to place an order:

Our customer service hours are Monday to Thursday from 10:30 a.m. to 1:30 p.m. and from 5:00 p.m. to 7:00 p.m., Friday from 10:30 a.m. to 1:30 p.m., Saturdays and Sundays closed. From now on, when we talk about deadlines on working days, they are counted from Monday to Friday.

For any order whose amount exceeds € 3,000, Triode Electronic Engineering S.L. It may ask for an identity document or proof of address that you must send us by email. We apologize for any inconvenience this procedure may cause you. These security measures are a reliable proof of our will to protect the clients of Triode Electronic Engineering S.L. against eventual bank fraud.

Product information

To make your purchase easier, we pay great attention to information regarding the characteristics of the products through descriptions, technical drawings, photographs and videos that illustrate the products. All the articles on the web have measurements and colors that give an approximation that is as faithful as possible to reality, but we do not guarantee that in all cases these descriptions are 100% accurate. You can verify all the information that generates doubts with the technical department, since for returns for reasons of this type the shipping and return costs will be borne by the user.

Prices

Prices are shown in euros (with Spanish taxes included. Where taxes are not applicable, they will be detracted from the total price during the purchase process). The shipping price will be added to the total sum of the amount of the selected products once the order is placed, as it is calculated based on the weight, volume, number of packages and shipping region.

We reserve the right to change our prices at any time. However, we undertake to apply the rates indicated on the web at the time of placing the order.

Availability

You must bear in mind that the orders will be sent within the limits of available stock once a product is requested. The corresponding request will be sent to our warehouse. We recommend that when you want to know the exact availability of a product you want to purchase, you contact us before making the payment in order to verify the availability of the product.

In any case, within a maximum period of 24 hours from the purchase Triode Electronic Engineering S.L. will send you an email confirming the availability, as well as the approximate lead time and subsequent delivery, understanding that confirmatory email as the moment of completion of the contract; In the event that any of the selected products are not available, the user will be given the possibility of changing the product or requesting a refund. Until the user does not carry out this action, the corresponding order will not be processed. In case of unjustified delay in the return of the amount paid, you can claim us double the amount owed, without prejudice to the right to be compensated for damages suffered in excess of said amount.

Shipping

We ship anywhere in the world. The pricing that appears by default in each article on the website does not include shipping costs and you can find out the exact amount of each shipment by doing a purchase simulation.

The order will be sent to the indicated address during purchase process. All orders will be delivered between 24 and 72 hours depending on the product stock. We do everything possible to respect the deadlines, but there will be specific moments of the year, such as national holidays, bank holidays, etc. in which we cannot guarantee them. That is why we thank you for your understanding about the fact that we are not responsible for delays in shipments due to unforeseeable or insurmountable reasons or causes of force majeure. In the event that you do not receive a package within three weeks from delivery, an investigation will be carried out together with the carrier which could last several days (the maximum period is fourteen business days). During this period or until the incident is clarified, no reshipment or refund of the order can be made.

We advise that, upon receiving the package, you verify that everything is in accordance with the order and in perfect condition. If you do not agree with the items recieved, sign and indicate by hand, on the delivery note that the courier hands you, the anomalies that you found upon receipt.

Protected payment

We put the following payment methods at your disposal:

• Credit or debit card: Visa, Visa Electron and Mastercard.
• Wire transfer.
• PayPal.

In case of choosing card payment, the payment will be charged at the time of order confirmation, provided that you have obtained prior authorization from your bank. If the payment has not been authorized, your order cannot be processed.

Right of withdrawal - Information on the exercise of the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within a period of 14 days without need for justification. The withdrawal period will expire 14 days from the day that you or a third party indicated by you, other than the carrier, acquires material possession of the goods.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal declaration (for example, a letter sent by post, fax or email). You can use the model withdrawal form below, although its use is not mandatory. You also have the option of electronically completing and sending the model withdrawal form or any other unequivocal declaration through our website thermion@thermion.eu. If you use this option, we will notify you without delay in a durable way (for example, by email) of the receipt of that withdrawal.

To meet the withdrawal period, it is sufficient that the communication regarding your exercise of the right of withdrawal is sent before the withdrawal period expires.

Consequences of withdrawal

In the event of withdrawal on your part, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the less expensive delivery method that we offer) without any undue delay and, in any case, no later than 14 days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make a reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise. In any case, you will not incur into any expenses as a result of the refund. We may withhold the refund until we have received the goods back, or until you have provided proof of the return of the goods, depending on which condition is met first.

You must return or deliver the goods to us without undue delay and, in any event, no later than 14 days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be considered met if you return the goods before the 14-day period has expired.

Warranty

In accordance with European regulations, all new durable products have a 2-year warranty from the date of purchase. Only guarantees of products purchased through this website are managed. The warranty exclusively covers manufacturing defects. It does not cover the improper use of products (non-compatible power supplies, poor connections, wear, symptoms as a result of humidity, high or low temperatures ...) or wear generated by use.

For any procedure related to the guarantee it is essential that you contact us via mail to thermion@thermion.eu explaining the situation. We will answer you as soon as possible. Shipping costs derived from repairs and/or replacements in warranty terms and covered by it, must be assumed by the customer.

"The very nature of the good limits or modulates the application of the Law: RDL 1/2007 does not expressly include within its scope of application perishable goods, meaning those that have a very limited period of life, disappearing the good or its usefulness when this period is exhausted or when it is consumed, so it can be considered that its provisions only apply to the extent that the nature of the good allows it."

Any product intervened or manipulated by personnel outside of Triode Electronic Engineering S.L. will be automatically excluded from the guarantee.

Returns due to an incident

Notwithstanding the applicable legal guarantees, we remind you that you must inform us of any incident within 48 business hours of receiving the order. Incidents will always be resolved by writing. After the stipulated period, we are not responsible for the incident or return.

• The steps to follow are those:
• Keep the original packaging, labels or any accessories that go inside the box.
• Send us an email at www.thermion.eu with photographs of the damage and a detailed explanation of it. Without photographs we will not be able to process the incident.
• We promise to answer your mail within a maximum period of 48 working hours with a solution to your problem. We will replace the entire article. The procedure will always be the same: first we collect the defective item in its original packaging, and when we receive it and check its condition we will send you a new one in perfect condition.

Safeguard clause

All the clauses or ends of this contract must be interpreted independently and autonomously, the rest of the stipulations not being affected in the event that one of them has been declared NULL by a final court ruling. The contracting parties agree to replace the clause or clauses affected by other or others that preserve the effects pursued by the parties.

Dispute resolution

Triode Electronic Engineering S.L. is not responsible for the non-execution of these conditions in the event of force majeure, as defined by the Spanish courts, and in the events of client’s fault or an unforeseeable event on the part of a person outside the contract. For any divergence caused by the breach of the purchase-sale conditions, the two parties will expressly submit to the courts of Albacete, except for what is established in the consumer regulations, waiving theirs if it were otherwise.

Triode Electronic Engineering S.L. is not responsible for the consequences that may result from an inappropriate use of the products sold on its website.

You also have the possibility, if you have problems with products or services purchased online, to use the EU online dispute resolution platform to submit a claim that will be resolved by an independent dispute resolution body.
